1. Scope of application

These terms of use of the website www.hw-search.com (the Terms of Use) govern the relationship between Ultra Consult S.A., operating under the commercial name "Harvey Weston", a public limited liability company incorporated under the laws of the Grand-Duchy of Luxembourg,  registered office at L-2317 Howald, 32 rue General Patton, registered with the Luxembourg trade and companies register under number B 103661 (the Company) and any user (the User) of the website www.hw-search.com (the Website).


2. Acceptance

By consulting and/or using this website, the User agrees with these Terms of Use without any limitation or reservation. The User waives any provision to the contrary from the User or any third party.

In case the User disagrees with these Terms of Use, he/she shall neither consult nor use the website.

3. Purpose

The purpose of the Website is to make available information on the Company and the services offered, as well as to publish job opportunities.

4. Processing of personal data

The Company may process personal data collected on the Website in order to provide the recruitment assistance services and to allow access to the Website . By consulting and using the Website, the User explicitly authorises the Company to use his/her data for the purposes set out above.

Before sharing any personal information on the User with potential employers, the Company will seek the User's consent.

The User may exercise his/her rights to access and rectify his/her data by contacting the Company.
The security of the data is guaranteed by appropriate technical means against any unauthorised access. The Company however generally declines liability in relation to the security of the data transmitted via the Internet.


5. Security and liability

Security and confidentiality issues have been taken into account by the Company when developing the Website. In case the information available on the Website and/or the data transmitted by or to the User would, despite the technical protection measures implemented by the Company, be intercepted, decrypted, transmitted to or used by any third party, altered, modified or deleted, the Company declines any liability in relation to direct or indirect consequences which would result therefrom for the User.

The Company declines any liability in relation to the direct or indirect consequences:

(a) of problems relating to the accessibility or availability of the Website for whatever reason; and
(b) of problems relating to the incompatibility of the Website with the User's IT equipment, its configuration, its Internet connection or in case of incapacity of the User's equipment to retrieve the information available on the Website in an appropriate manner and/or to transmit the information relating to the User; and
(c) of any damages caused to the User's hardware or software configuration, as well as of any loss of data resulting from the use of the Website; and
(d) of the use of electronic communication means (including but not limited to e-mail) for purposes of communication between the Company and the User which would contain computer viruses or be intercepted or altered by third parties.

The User accepts that any use of the Website will be under his/her own responsibility. The Company reserves itself the right to modify the Website, to modify or delete any information available on the Website or to cease its publication at any time.

The Company shall in no event be held liable for any direct or indirect damages resulting from the use of the Website or of information available on the Website.



The Company reserves itself the right to amend these Terms of Use at any time. The amendments shall be effective upon their publication on the Website on the date mentioned at the beginning of these Terms of Use. It is up to the User to consult these Terms of Use before browsing the website.
The User who does not wish to accept these Terms of Use in their current version or in any future version shall not consult and/or use the website.


7. Applicable law

The present Terms of Use are governed by the laws of the Grand-Duchy of Luxembourg.
The courts of the District of Luxembourg shall have exclusive jurisdiction for any litigation arising between the User and the Company.


8. Miscellaneous

In case a provision of these Terms of Use would infringe any compulsory or public order provision or in case a provision would be void for any other reason, the validity of the other provisions of these Terms of Use shall not be affected. The parties shall, to the extent possible, undertake to replace the null or void provision by a valid provision which shall preserve the contractual economy and reflect the initial spirit on which these Terms of Use are based.

You have at some time voluntarily sent us your CV or résumé and/or other correspondence containing personal and professional data. 
This information has been carefully kept by us and not shown to any third party without your prior consent according to our privacy policy.


However, the new European General Data Protection Regulation, which came into force on 25th May this year gives you the right to request, modify and delete any information on you kept by us.  Please therefore let us know, at your earliest opportunity, if you wish to exercise such rights and if so which and when.
